2. Purpose
These Terms and Conditions of Sale define the rights and obligations of the parties in connection with the online sale of products offered by Kowa Europe GmbH – Paris Branch, under the brand TAION Europe, to consumers via the website taion-wear.eu (the “Site”).
3. Products
The products offered for sale on the Site are described and presented as accurately as possible.
However, minor variations in color, texture, or details may occur between the photographs or descriptions and the actual products.
Such variations shall not constitute a defect or non-conformity of the product.
All products are offered subject to availability. In the event of an error or stock unavailability, TAION Europe reserves the right to cancel or refuse an order.
4. Prices
Prices are displayed in euros (€) and include all applicable taxes (TTC – Toutes Taxes Comprises).
Shipping costs, if any, are indicated before the final order confirmation.
TAION Europe reserves the right to modify prices at any time; however, the products will be invoiced based on the prices in effect at the time of order confirmation.
In the event of a pricing error on the Site, TAION Europe reserves the right to cancel any affected orders after notifying the customer.
5. Orders
An order is considered final once the customer clicks the “Place Order” button and receives an order confirmation email from TAION Europe.
This confirmation email constitutes acceptance of the order and forms a binding sales contract between the customer and TAION Europe.
TAION Europe reserves the right to cancel or refuse any order in the event of an existing dispute, suspicion of fraud, or irregularity in payment.
6. Payment
Accepted payment methods include:
• Credit and debit cards (Visa, MasterCard, American Express, etc.)
Payment is due immediately upon placing the order. All transactions on the Site are processed through secure and encrypted payment systems that comply with current European standards, including Strong Customer Authentication (SCA).
TAION Europe reserves the right to suspend or cancel any order in case of non-payment, payment authorization refusal by the banking institution, or suspicion of fraud.
7. Delivery
Products are shipped to the delivery address provided by the customer at checkout.
Delivery times are indicated on the Site and may vary depending on the destination, carrier, and product availability.
In the event of a delivery delay, the customer will be informed by email. If delivery cannot be fulfilled within 30 days from the order confirmation, the customer may cancel the order and obtain a full refund.
The risk of loss or damage is transferred to the customer upon physical receipt of the goods by the customer or by a third party designated by the customer.
TAION Europe shall not be held liable for delivery failures caused by incorrect or incomplete addresses provided by the customer, or by circumstances beyond its reasonable control (e.g., customs delays, strikes, force majeure).
8. Right of Withdrawal (Returns)
In accordance with Article L.221-18 of the French Consumer Code and Directive 2011/83/EU, consumers have a 14-day withdrawal period from the date of receipt of their order to cancel their purchase without providing any reason.
To exercise this right, the customer must notify TAION Europe by email at info@taion-wear.eu before the 14-day period expires.
Returned products must be in their original condition and packaging, unworn, unwashed, and with all tags attached.

Unless otherwise stated, return shipping costs are borne by the customer.
Refunds will be issued within 14 days of receipt of the returned goods, using the same payment method as the original transaction.
The right of withdrawal does not apply to products that have been worn, washed, damaged, or customized, as well as to sealed items that have been opened after delivery for hygiene reasons.
9. Legal Guarantees
All products sold by TAION Europe are covered by:
• The legal guarantee of conformity (Articles L217-4 to L217-14 of the French Consumer Code and Directive (EU) 2019/771), and
• The guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).
In accordance with these legal guarantees, if a product is found to be defective, non-conforming, or affected by a hidden defect, TAION Europe will repair, replace, or refund the product at no cost to the customer, in compliance with applicable legal provisions.
These legal guarantees apply independently of any commercial warranty that may be offered by TAION Europe or third parties.
10. Liability
TAION Europe cannot be held liable for damages resulting from misuse, negligence, or failure to follow the care instructions of the purchased products.
TAION Europe shall not be responsible for indirect, consequential, or non-material damages such as loss of profit, loss of opportunity, or data loss.
Nothing in these Terms and Conditions shall limit or exclude TAION Europe’s liability in cases of personal injury or death caused by negligence, fraud, or willful misconduct, in accordance with applicable consumer protection laws.
11. Intellectual Property
All content available on the Site, including but not limited to texts, images, logos, graphics, videos, icons, and page layouts, is the exclusive property of TAION Europe or its partners and is protected by applicable intellectual property laws, including copyright, trademark, and design rights.
The TAION name and logo are registered trademarks and may not be used, reproduced, or imitated, in whole or in part, without the prior written consent of TAION Europe.
Any unauthorized use of the Site or its content shall constitute an infringement of intellectual property rights and may lead to legal action.
12. Personal Data
Customer data is collected and processed by TAION Europe for the purposes of order management, delivery, invoicing, and customer service.
TAION Europe acts as the Data Controller under the EU General Data Protection Regulation (GDPR – Regulation (EU) 2016/679).
Personal data is stored securely and retained only for the duration necessary to fulfil the purposes for which it was collected or to comply with legal obligations.
In accordance with the GDPR, customers have the right to access, rectify, delete, restrict, or object to the processing of their personal data, as well as the right to data portability.

13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by French law.
However, consumers residing in another member state of the European Union may also benefit from the mandatory provisions of their country of residence in accordance with Regulation (EC) No 593/2008 (“Rome I”).
In the event of a dispute, both parties shall first attempt to reach an amicable settlement.
In accordance with Article L612-1 of the French Consumer Code, consumers may refer the dispute free of charge to a consumer mediation service before taking any legal action.
If no amicable agreement is reached, disputes shall be submitted to the competent French courts having jurisdiction.
